1. Acceptance of Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Crow Squared LLC ("Company," "we," "us," or "our") governing your access to and use of Flight Incident Files (the "Service"), including any content, functionality, and services offered through our website.
By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the Service.
We reserve the right to modify these Terms at any time. We will provide notice of material changes by updating the "Last Updated" date and, for significant changes, by posting a notice on the Service or sending you an email. Your continued use of the Service after any changes constitutes acceptance of the modified Terms.
2. Description of Service
Flight Incident Files provides a searchable archive of aviation accident and incident investigation reports sourced from publicly available National Transportation Safety Board (NTSB) records. The Service includes:
- Free Features: Access to search and read over 150,000 NTSB investigation reports, including probable causes, factual narratives, and safety recommendations.
- Premium Features (Investigator Membership): Audio narrative generation, analytics dashboards (safety intelligence, temporal trends, fleet risk analysis), data export capabilities, and access to the community audio library.
The Service is provided for educational and research purposes. We strive to present accurate information, but we do not guarantee the completeness, accuracy, or timeliness of the data.
3. User Accounts
3.1 Account Creation
To access certain features of the Service, you must create an account. You may register using your email address and a password, or through Google OAuth. You agree to provide accurate, current, and complete information during registration.
3.2 Account Security
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account or any other security breach.
3.3 Account Restrictions
You may not share your account credentials with others or allow multiple people to use your account. We reserve the right to suspend or terminate accounts that we reasonably believe are being shared or misused.
4. Subscriptions and Billing
4.1 Subscription Plans
The Investigator membership is offered as a monthly subscription at the price displayed on our pricing page (currently $14.99 per month). Prices are subject to change with reasonable notice.
4.2 Automatic Renewal
Subscriptions automatically renew at the end of each billing period unless you cancel before the renewal date. You authorize us to charge your payment method on file for each renewal period.
4.3 Cancellation
You may cancel your subscription at any time through your account settings or by contacting us. Cancellation will take effect at the end of your current billing period. You will continue to have access to premium features until the end of the period for which you have paid.
4.4 Refunds
Subscription fees are generally non-refundable. However, if you believe you are entitled to a refund due to technical issues or other extraordinary circumstances, please contact us and we will review your request on a case-by-case basis.
4.5 Payment Processing
All payments are processed securely by Stripe. By providing payment information, you represent that you are authorized to use the payment method and authorize us to charge the applicable fees.
5. Audio Credits
5.1 Credit Allocation
Investigator members receive 10 audio generation credits per month. Credits are allocated at the start of each billing period.
5.2 Credit Usage
Each audio narrative generation consumes one credit. Once generated, audio narratives are added to the community library and become available to all users.
5.3 Credit Expiration
Unused credits do not roll over to the next billing period unless otherwise specified. Credits have no cash value and cannot be transferred or refunded.
5.4 Credit Retention on Cancellation
If you cancel your subscription, any remaining credits will remain in your account and can be used until they expire or until your access period ends.
6. User-Generated Content
6.1 Community Library
When you generate an audio narrative using your credits, that narrative is automatically added to our community library and made available to other users of the Service. By generating audio content, you agree to share it with the community.
6.2 License Grant
By contributing audio narratives to the community library, you grant Crow Squared LLC a worldwide, non-exclusive, royalty-free, perpetual license to use, reproduce, distribute, display, and create derivative works from your contributions in connection with the Service.
6.3 Content Standards
Audio narratives are generated from NTSB investigation reports using AI technology. While we review content for quality, we reserve the right to remove any content that we determine, in our sole discretion, violates these Terms or is otherwise objectionable.
7. Intellectual Property
7.1 Our Intellectual Property
The Service, including its design, features, functionality, and content (excluding NTSB public data and user-generated content), is owned by Crow Squared LLC and is protected by copyright, trademark, and other intellectual property laws.
7.2 NTSB Data
Investigation reports and related data sourced from the National Transportation Safety Board are public records in the public domain. Our presentation, organization, and enhancement of this data (including generated narratives and analytics) constitute our intellectual property.
7.3 Limited License
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable license to access and use the Service for personal, non-commercial purposes. You may not reproduce, distribute, modify, or create derivative works from the Service without our prior written consent.
8. NTSB Data Disclaimer
IMPORTANT NOTICE:
Flight Incident Files is NOT affiliated with, endorsed by, or connected to the National Transportation Safety Board (NTSB) or any other government agency. All data is sourced from publicly available NTSB records.
This Service is provided for educational and research purposes only. The information presented should not be used as the sole basis for any safety-critical decisions. For official records and authoritative information, please visit www.ntsb.gov.
AI-generated audio narratives are interpretive summaries and may not capture all nuances of the original investigation reports. Users should refer to official NTSB reports for complete and authoritative information.
9. Prohibited Conduct
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable laws
- Attempt to gain unauthorized access to any part of the Service or its related systems
- Use automated scripts, bots, or scrapers to access or extract data from the Service
- Interfere with or disrupt the integrity or performance of the Service
- Impersonate any person or entity, or falsely represent your affiliation with any person or entity
- Share, sell, or transfer your account or subscription to another person
- Use the Service to harass, abuse, or harm others
- Reverse engineer, decompile, or attempt to extract the source code of the Service
- Remove, alter, or obscure any copyright, trademark, or other proprietary notices
- Use the Service in a manner that could damage, disable, or impair the Service
- Misrepresent the source or origin of any content, including claiming AI-generated narratives as official NTSB content
10. Termination
10.1 Termination by You
You may terminate your account at any time by contacting us or using the account deletion feature. If you have an active subscription, please cancel it first to avoid future charges.
10.2 Termination by Us
We may suspend or terminate your access to the Service immediately, without prior notice or liability, if you breach these Terms or engage in conduct that we determine, in our sole discretion, is harmful to the Service, other users, or third parties.
10.3 Effect of Termination
Upon termination, your right to use the Service will immediately cease. We may delete your account data in accordance with our data retention policies. Audio narratives you contributed to the community library will remain available.
11. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.
To the fullest extent permitted by law, Crow Squared LLC disclaims all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the Service will be uninterrupted, timely, secure, or error-free, or that any errors will be corrected. We do not warrant the accuracy, completeness, or reliability of any content available through the Service.
The information provided through the Service, including AI-generated narratives, is for general informational and educational purposes only and should not be relied upon for flight safety decisions or professional aviation purposes.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CROW SQUARED LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL.
In no event shall our total liability exceed the greater of (a) the amount you paid us in the twelve (12) months preceding the claim, or (b) one hundred dollars ($100).
Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.
13. Indemnification
You agree to indemnify, defend, and hold harmless Crow Squared LLC and its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:
- Your use or misuse of the Service
- Your violation of these Terms
- Your violation of any applicable laws or regulations
- Any content you submit or contribute to the Service
- Your infringement of any third-party rights
14. Dispute Resolution and Arbitration
14.1 Informal Resolution
Before initiating any formal dispute resolution, you agree to first contact us at support@crowsquared.com to attempt to resolve the dispute informally. We will attempt to resolve the dispute within thirty (30) days.
14.2 Binding Arbitration
If we cannot resolve a dispute informally, any dispute, controversy, or claim arising out of or relating to these Terms or the Service shall be resolved by binding arbitration administered by the American Arbitration Association ("AAA") in accordance with its Consumer Arbitration Rules.
The arbitration will be conducted in the English language. The arbitrator's decision shall be final and binding, and judgment on the award may be entered in any court of competent jurisdiction.
14.3 Class Action Waiver
YOU AND CROW SQUARED LLC AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.
14.4 Exceptions
Notwithstanding the above, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of intellectual property rights.
15. General Provisions
15.1 Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United States and the State of Delaware, without regard to its conflict of law provisions.
15.2 Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Crow Squared LLC regarding the Service and supersede all prior agreements and understandings.
15.3 Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
15.4 Waiver
Our failure to enforce any right or provision of these Terms shall not be considered a waiver of that right or provision.
15.5 Assignment
You may not assign or transfer these Terms or your rights under them without our prior written consent. We may assign our rights and obligations under these Terms without restriction.
15.6 Force Majeure
We shall not be liable for any failure or delay in performing our obligations where such failure or delay results from circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, strikes, or shortages of transportation, facilities, fuel, energy, labor, or materials.
